PART I – USER AGREEMENT FOR THE SPEEDBOX SERVICES

This agreement (”Agreement”) sets forth the legally binding terms and conditions for your use of the services provided by SPEEDBOX IBERIA, S.A., registered in Madrid, Paseo de la Castellana, 161, 2nd floor, 28046 and with CIF A81767295. (”SPEEDBOX”, ”Speed Box”, ”we”, ”our”, or ”us”).

SERVICE DESCRIPTION

The provided service consists of a temporary rental of a storage compartment within a secure locker system.

• Access to the rented unit may be made available via a self-service terminal, a mobile device, QR code, or other digital interface.
• The agreement is initiated upon confirmation through the method presented at the point of rental (e.g., web, terminal, or app).
• The service is considered completed when the user has finalized payment and removed their belongings from the locker.
• During the rental period, SPEEDBOX or its authorized partners may access the locker for purposes such as maintenance, inspection, or system operations.

STORAGE DURATION, PENALTIES AND DEPOSIT TERMS

Time-Limited Storage

Lockers are rented for a specified period chosen at the time of purchase. Any usage beyond this period constitutes overdue usage and may incur penalty fees, including charges for unallocated time.

Right to Empty and Forfeit Goods

If the locker remains in use beyond the agreed rental period, SPEEDBOX and/or its authorized partners reserve the right to:

• Access and empty the locker without prior notice
• Charge handling and administrative fees
• Forfeit and dispose of the contents, including destruction, transfer to third parties, or handover to authorities

Deposit and Forfeiture

A refundable deposit is required at the start of each rental. It will be returned only if the locker is properly closed within 30 seconds after the session ends. Failure to do so will result in full forfeiture of the deposit.

LIABILITY, RESPONSIBILITY AND SUPPORT FEES

Minimum Notice Period

Customers must allow at least 1 hour between when they plan to retrieve their goods and when they actually need the items. This buffer period is necessary to allow SPEEDBOX sufficient time to assist in case of any technical issues or other problems. If a customer experiences any issues (such as missed transportation) due to problems with the service occurring within 1 hour before their scheduled departure, SPEEDBOX cannot assume any responsibility for such consequences.

Use at Own Risk

You use the service and store goods at your own risk. SPEEDBOX assumes no responsibility for damage or loss of stored items, except as specifically stated.

Limited Compensation

If SPEEDBOX causes a fault that leads to service failure, we may compensate you up to a maximum of EUR 150. This does not include indirect or consequential losses.

Force Majeure

SPEEDBOX shall not be held liable for any failure or delay in performance resulting from events beyond its reasonable control, including but not limited to power outages, network failures, or other unforeseen technical or operational disruptions. Furthermore, SPEEDBOX disclaims any responsibility for access restrictions or closures imposed by property owners, site operators, or hosting partners, including instances where such restrictions deviate from communicated opening hours displayed on signage or websites.

User Errors

We are not liable for issues caused by:

• Failure to follow instructions
• Use of uncharged or disconnected devices
• Mistaken interactions (e.g., opening or not closing a locker)
• Insufficient funds or payment failures
• Any other user-related error

Emergency Assistance Fees

At certain stations, emergency assistance (call-out) may be available. If such assistance is required due to user error or a fault attributable to you, you will be charged for all associated costs, including any rental-related extensions. If the issue is caused by SPEEDBOX, the associated costs will be borne by SPEEDBOX.

UNCLAIMED GOODS AND OVERDUE USAGE

All stored items remaining after the prepaid rental period are considered overdue. SPEEDBOX and/or its authorized partners reserve the right to:

• Immediately access and remove such items
• Charge additional fees
• Forfeit and dispose of the contents without further notice or compensation

You waive any right to reclaim or seek compensation for items left beyond your rental period.

SPEEDBOX and our partners reserve the right to dispose of the goods, surrender them to law enforcement authorities, or proceed with their sale.

PROHIBITED USE AND LAW ENFORCEMENT COOPERATION

Prohibited Contents

Lockers may not be used to store:

• Weapons or firearms
• Narcotics or illegal substances
• Explosives or dangerous materials
• Stolen or unlawful goods
• Perishables or items that may cause odor, damage, or risk to others
• Living beings, including pets, children, or any human

Misuse and Confiscation

Suspected misuse may result in:

• Immediate termination of the rental
• Forced entry and removal of contents
• Forfeiture and reporting to the police

Disclosure of Information

By using the service, you authorize SPEEDBOX to disclose your usage history, transaction details, and contact information to law enforcement upon legal request or suspicion of misuse.

PRIVACY POLICY

SPEEDBOX IBERIA, S.A. processes personal data in accordance with the General Data Protection Regulation (GDPR) and other applicable laws. The following principles apply:

• Purpose: Personal data is collected to provide storage services and manage payments and communication with the customer.
• Collected Information: Name, contact details, payment information, and usage history.
• Retention Period: Data is stored only as long as necessary to fulfill contractual and legal obligations.
• Third Parties: Data is shared only with trusted payment service providers and, when legally required, with authorities.
• Security: Data is protected through technical and organizational measures to prevent unauthorized access.

PART II – WEBSITE TERMS OF USE

LICENSE

SPEEDBOX grants you a revocable, non-exclusive, non-transferable, limited license to download, install and use the website strictly in accordance with the terms of this Agreement.

MEANINGS

For this Agreement:

• Cookie: small amount of data generated by a website and saved by your web browser. It is used to identify your browser, provide analytics, remember information about you such as your language preference or login information.
• Company: when this policy mentions ”Company,” ”we,” ”us,” or ”our,” it refers to SPEEDBOX IBERIA, S.A. (Madrid, Paseo de la Castellana, 161, 2nd floor, 28046) that is responsible for your information under these Terms & Conditions.
• Country: where SPEEDBOX or the owners/founders of SPEEDBOX are based, in this case is Sweden.
• Device: any internet connected device such as a phone, tablet, computer or any other device that can be used to visit SPEEDBOX and use the Services.
• Service: refers to the service provided by SPEEDBOX as described in the relative terms (if available) and on this platform.
• Third-party service: refers to advertisers, contest sponsors, promotional and marketing partners, and others who provide our content or whose products or services we think may interest you.
• Website: SPEEDBOX’s site, which can be accessed via this URL: www.speedbox.eu
• You: a person or entity that is registered with SPEEDBOX to use the services.
• Overdue usage: usage of the service for a longer period than agreed which is specified before each purchase.
• Partners: subcontractors, customers or site providers with a valid cooperation agreement with us.

RESTRICTIONS

You agree not to, and you will not permit others to:

• License, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose or otherwise commercially exploit the website or make the platform available to any third party.
• Modify, make derivative works of, disassemble, decrypt, reverse compile or reverse engineer any part of the website.
• Remove, alter or obscure any proprietary notice (including any notice of copyright or trademark) of SPEEDBOX or its affiliates, partners, suppliers or the licensors of the website.

YOUR SUGGESTIONS

Any feedback, comments, ideas, improvements or suggestions (collectively, ”Suggestions”) provided by you to SPEEDBOX with respect to the website shall remain the sole and exclusive property of SPEEDBOX. SPEEDBOX shall be free to use, copy, modify, publish, or redistribute the Suggestions for any purpose and in any way without any credit or any compensation to you.

COOKIES

SPEEDBOX uses ”Cookies” to identify the areas of our website that you have visited. A Cookie is a small piece of data stored on your computer or mobile device by your web browser. We use Cookies to enhance the performance and functionality of our website but these are non-essential to their use. However, without these cookies, certain functionalities like videos may become unavailable or you would be required to enter your login details every time you visit the website as we would not be able to remember that you had logged in previously. Most web browsers can be set to disable the use of Cookies. However, if you disable Cookies, you may not be able to access functionalities on our website correctly or at all. We never place Personally Identifiable Information in Cookies.

You acknowledge and agree that SPEEDBOX shall not be responsible for any Third-Party Services, including their accuracy, completeness, timeliness, validity, copyright compliance, legality, decency, quality or any other aspect thereof. SPEEDBOX does not assume and shall not have any liability or responsibility to you or any other person or entity for any Third-Party Services.

Third-Party Services and links thereto are provided solely as a convenience to you and your access to use them is entirely at your own risk and subject to such third parties’ terms and conditions.

UPDATES TO OUR WEBSITE

SPEEDBOX may from time to time provide enhancements or improvements to the features/functionalities of the website, which may include patches, bug fixes, updates, upgrades and other modifications (”Updates”).

Updates may modify or delete certain features and/or functionalities of the website. You agree that SPEEDBOX has no obligation to (i) provide any Updates, or (ii) continue to provide or enable any particular features and/or functionalities of the website to you.

You further agree that all Updates will be (i) deemed to constitute an integral part of the website, and (ii) subject to the terms and conditions of this Agreement.

INTELLECTUAL PROPERTY

The website and its entire contents, features and functionality (including but not limited to all information, software, text, displays, images, video and audio, and the design, selection and arrangement thereof), are owned by SPEEDBOX, its licensors or other providers of such material and are protected by Sweden and international copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws. The material may not be copied, modified, reproduced, downloaded or distributed in any way, in whole or in part, without the express prior written permission of SPEEDBOX, unless and except as is expressly provided in these Terms & Conditions. Any unauthorized use of the material is prohibited.

INDEMNIFICATION

You agree to indemnify and hold SPEEDBOX and its parents, subsidiaries, affiliates, officers, employees, agents, partners and licensors (if any) harmless from any claim or demand, including reasonable attorneys’ fees, due to or arising out of your: (a) use of the website; (b) violation of this Agreement or any law or regulation; or (c) violation of any right of a third party.

NO WARRANTIES

The website is provided to you ”AS IS” and ”AS AVAILABLE” and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, SPEEDBOX, on its own behalf and on behalf of its affiliates and its and their respective licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory or otherwise, with respect to the website, including all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and warranties that may arise out of course of dealing, course of performance, usage or trade practice.

Without limitation to the foregoing, SPEEDBOX provides no warranty or undertaking, and makes no representation of any kind that the website will meet your requirements, achieve any intended results, be compatible or work with any other software, systems or services, operate without interruption, meet any performance or reliability standards or be error free or that any errors or defects can or will be corrected.

LIMITATION OF LIABILITY

Notwithstanding any damages that you might incur, the entire liability of SPEEDBOX and any of its suppliers under any provision of this Agreement and your exclusive remedy for all of the foregoing shall be limited to the amount actually paid by you for the website.

To the maximum extent permitted by applicable law, in no event shall SPEEDBOX or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, for loss of data or other information, for business interruption, for personal injury, for loss of privacy arising out of or in any way related to the use of or inability to use the website, third-party software and/or third-party hardware used with the website, or otherwise in connection with any provision of this Agreement), even if SPEEDBOX or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.

FINAL PROVISIONS

Changes to Terms

SPEEDBOX may revise these terms without notice. Continued use implies acceptance of any changes.

Termination

We may terminate service or access to lockers at any time in case of violations.

Governing Law

This Agreement shall be governed by and interpreted in accordance with the laws of Sweden.

Dispute Resolution

Disputes may be referred to the Arbitration Institute of the Stockholm Chamber of Commerce (SCC) or submitted to the EU’s online dispute resolution platform available at https://ec.europa.eu/consumers/odr.
